§ 72.01 PARKING VIOLATIONS BUREAU ESTABLISHED.

There is hereby established, pursuant to M.C.L.A. §§ 600.8395, a Parking Violations Bureau, which shall be under the supervision and control of the City Council and its authorized agents.

§ 72.02 LOCATION AND OPERATION OF BUREAU; EMPLOYEES; POWERS.

The City Council shall establish a convenient location for the Parking Violations Bureau and appoint qualified city employees to administer the Bureau and adopt rules and regulations for the operation thereof. The Bureau shall have authority to dispose of only those violations scheduled in § 72.05. An alleged violator is not entitled to disposition of the violation by the Bureau. If the Bureau refuses to dispose of the alleged violation, any person having knowledge of the facts may make a sworn complaint before any court with jurisdiction of the offense as provided by law.

§ 72.03 DISPOSITION OF ALLEGED PARKING VIOLATIONS.

A parking violation may be settled at the Parking Violations Bureau only if the alleged violator so requests. The Bureau shall not accept any penalty for any violation unless the alleged violator accepts responsibility for the violation. The Bureau shall not attempt to determine the truth or falsity of any fact or matter relating to the alleged violation. A person alleged to have committed a parking

violation is not required to have the Bureau dispose of the alleged parking violation, but may have a court of competent jurisdiction dispose of the alleged parking violation. The election to have an alleged parking violation disposed of by a court of competent jurisdiction shall not prejudice or in any way diminish the rights, privileges and protections accorded to a person by law.

§ 72.04 TRAFFIC TICKETS; EFFECT; CONTENTS.

The issuance of a traffic ticket or notice of a parking violation by a police officer of the city shall be deemed an allegation of a parking violation. The ticket or notice of a parking violation shall indicate the time within which the alleged violator must respond before the Parking Violations Bureau by accepting responsibility, accepting responsibility with explanation, or denying responsibility for the alleged parking violation. It shall also state the address of the Bureau, the hours during which the Bureau is open, the amount of the penalty scheduled for the offense for which the ticket or notice of violation was issued, and advise that judgment may be entered by a court of competent jurisdiction and that the alleged violator's license may be revoked.

§ 72.06 DUTY TO OBEY PARKING SIGNS; TOWING.

When signs prohibiting parking are erected, no person shall park his or her or their vehicle in any so-designated place. A vehicle illegally parked may be towed away and stored at the direction of an officer of the Police Department of the city at the owner's expense.

§ 72.99 PENALTY.

Any violation of this chapter shall constitute a civil infraction subject to a civil fine as specified in § 72.05. A judge or magistrate may impose costs not exceeding $100 if he or she finds an alleged violator responsible for a parking violation hereunder.
