CHAPTER 32:   PUBLIC WORKS DEPARTMENT

§ 32.01  ESTABLISHED.
	There is hereby established a Public Works Department to be known as the Ferrysburg
	Public Works Department.

§ 32.02  PUBLIC WORKS COMMISSION.
	The Public Works Department shall be under the control of a board known as the Public
	Works Commission consisting of three members, all of whom shall be appointed by the
	Mayor with the approval of the City Council. One member shall be appointed from either
	the administrative staff of the city or from the City Council in the discretion of the
	Mayor and two members shall be appointed from the city at large. All of the members
	shall be required to be residents of the city. The terms of the members of the Commission
	shall be for a period of two years, provided, that of the first appointments, one shall
	be for one year and one for two years. The member appointed from the Council or
	administrative staff shall hold office for an indefinite term or until his or her
	successor is duly appointed and qualified. All terms of members of the Commission shall
	begin on July 1 in the year of appointment.

§ 32.03  JURISDICTION AND DUTIES OF COMMISSION.
		(A)	The streets and water and sewer systems and parks together with
			all recreation facilities of the city shall be under the
			jurisdiction of the Public Works Commission unless otherwise
			provided by contract or city ordinance. The general function and
			duties of the Commission shall include the following:

		(1)	To maintain all streets, alleys and public rights-of-way as well as
			parks and recreation facilities;

		(2)	To keep records of street and highway work for state gas weight
			funds, according to state law;

		(3)	To work with the city engineers on all street and highway projects;

		(4)	To prepare and submit a plan for improvements on city units under
 			its jurisdiction annually or as directed by the City Council.

	(B)	The Commission shall negotiate contracts for improvement, extension,
		repair, and maintenance of these facilities subject to approval and
		appropriation by the City Council. The Commission shall hold a meeting not
		less than one quarter-annually and shall report to the City Council on its
		activities.

	(C)	The Commission shall draw up rules and regulations and bylaws to govern its
		meetings, and procedures which shall be followed in all meetings. The
		Commission shall annually prepare a budget of personnel and proposed
		expenses of the Public Works Department and present it to the Budget
		Officer prior to March 15 of each year.

§ 32.04	SUPERINTENDENT OF PUBLIC WORKS; OTHER OFFICERS AND EMPLOYEES.
	The Public Works Department shall be managed by the Superintendent of Public
	Works who shall be appointed by the Public Works Commission with the approval of
	the City Council, and such other officers and employees as shall be approved by
	the Public Works Commission. All employees of the Public Works Department shall
	serve at the discretion of the Public Works Commission except the Superintendent
	of Public Works and the City Engineer, who shall serve at the discretion of the
	City Council.

PLANNING COMMISSION

§ 32.01  ESTABLISHED.
	There is hereby created a commission to be known as the "City of Ferrysburg
	Planning Commission," which Commission shall consist of nine members and which
	Commission shall be vested with any and all powers permitted to be fixed in a
	Planning Commission as provided by law.

§ 32.02  COMPOSITION; TERM OF OFFICE.
	The Planning Commission shall consist of nine members, one of whom shall be a
	member of the City Council to be selected by resolution of the Council to serve
	as a member ex officio, and eight of whom shall be appointed by the Mayor subject
	to the approval of the Council by majority vote. An appointed member shall not
	hold another municipal office except that one of the appointed members may be a
	member of the Zoning Board of Appeals. The term of the ex officio member shall be
	determined by the Council and shall be stated in the resolution selecting the ex
	officio member, but the term shall not exceed the member's term of office as a
	Council Member. The term of each appointed member shall be three years, or until
	his or her successor takes office. The ex officio member appointed under this
	section shall have full voting rights.

§ 32.03  COMPENSATION.
	All members of the Planning Commission shall serve without compensation. After
	public hearing, a member other than the member selected by the Council may be
	removed by the Mayor for inefficiency, neglect of duty or malfeasance in office.
	The Council may for like cause remove the member selected by the Council.

§ 32.04  OFFICERS ELECTED; MEETINGS, RULES, AND RECORDS.
	The Planning Commission shall elect its Chairman from among its members appointed
	by the Mayor and fill such other of its offices as it may determine. The term of
	the Chairman shall be one year with eligibility of re-election. The Planning
	Commission shall hold at least one regular meeting in each month and shall adopt
	rules for transaction of business and shall keep a record of its resolutions,
	transactions, findings and determinations, which record shall be a public record.

§ 32.05  EMPLOYEES APPOINTED; CONSULTANTS; EXPENDITURES.
	The Planning Commission may appoint such employees as it may deem necessary for
	its work, whose appointment, promotion, demotion and removal shall be subject to
	the same provisions of law as govern other corresponding civil employees of the
	city. The Planning Commission may also contract with city planners, engineers,
	architects and other consultants for such services as it may require. The
	expenditures of said Commission, exclusive of gifts, shall be within amounts
	appropriated for the purpose by the City Council, which shall provide the funds,
	equipment and accommodations necessary for the Planning Commission's work.

RECREATION COMMISSION

§ 32.15  ESTABLISHED.
	There is hereby created a Recreation Commission for the city in accordance with
	the City Charter.

§ 32.16  COMPOSITION; VACANCIES; APPOINTMENT.
	The Recreation Commission shall consist of seven members who shall serve for terms
	 of three years; vacancies on the Commission will be filled in the same manner as
	the original appointments are made. The members of the Commission shall be
	appointed by the Mayor with the consent of the City Council.

§ 32.17  FUNDING; EXPENDITURES.
	All funds of the Recreation Commission shall be appropriated and expended under
	the authority of the City Council.

§ 32.18  DUTIES.
	The duties of the Recreation Commission will be to recommend purchase of
	recreational facilities and the formulation of programs, and in all ways to assist
	the City Council in an advisory capacity with reference to all matters of a
	recreational nature.

KITCHEL-LINDQUIST DUNES PRESERVE COMMITTEE

§ 32.30  ESTABLISHED.
	There is hereby established a Kitchel-Lindquist Dunes Preserve Committee in
	accordance with Charter § 4.25.

§ 32.31  PURPOSES.
	The purposes of the Committee are to advise and assist the city:

	(A)	In the operation, maintenance and development of the Preserve as a nature
		preserve for scientific, educational, aesthetic and recreational purposes;


	(B)	In the preparation and updating of a Master Plan for the Preserve;

	(C) 	In raising funds for implementation of the elements of the Master Plan; and

	(D)	In sponsoring public activities and events which promote the appreciation,
		enjoyment and preservation of the Preserve.

§ 32.32	EXECUTIVE BOARD.
	The Committee shall be directed by an Executive Board consisting of six members who
	shall serve for terms of two years ending on July 1. Board members shall be
	appointed by the Mayor with the consent of the City Council. Any vacancy on the
	Board shall be filled for the remainder of the unexpired term of office, by
	appointment by the Mayor with the consent of the City Council.

§ 32.33  MEMBERSHIP.
	Any person who subscribes to the purposes of the Committee is eligible to become a
	member of the Committee.

§ 32.34  BYLAWS.
	The Committee may adopt bylaws for its operations, provided that bylaws and any
	amendments thereto shall be approved by City Council prior to becoming effective.
